Please read these Terms carefully before using Device Tracker. By downloading or using the App you agree to be bound by these Terms. If you do not agree, do not download or use the App.

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the developer of Device Tracker ("Developer," "we," "us," or "our") governing your use of the Device Tracker iOS application ("App"). These Terms apply in addition to Apple's standard Licensed Application End User License Agreement (EULA), which is incorporated herein by reference.

We reserve the right to modify these Terms at any time. Material changes will be reflected by an updated "Last updated" date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes.

3. Subscriptions and In-App Purchases

3.1 Available Plans

Device Tracker offers auto-renewable subscription plans that unlock premium features. Current plans are displayed in the App at the time of purchase and may include:

Prices are set in your local currency and are displayed before you complete a purchase. Prices may vary by region and are subject to change with reasonable notice.

3.2 Free Trial

Where a free trial is offered, access to premium features begins immediately upon starting the trial. If you do not cancel before the trial period ends, your payment method will be charged the applicable subscription price automatically. Only one free trial is available per Apple ID per subscription product.

3.3 Automatic Renewal

Important: Subscriptions automatically renew at the end of each billing period at the current subscription price unless you cancel at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

3.4 Managing and Cancelling Your Subscription

You can manage or cancel your subscription at any time through your Apple ID account settings:

  1. Open the Settings app on your iPhone.
  2. Tap your name at the top, then tap Subscriptions.
  3. Select Device Tracker and tap Cancel Subscription.

Cancellation takes effect at the end of the current billing period. You retain access to premium features until that date. We do not offer refunds for partial subscription periods, except as required by applicable law or as provided by Apple's own refund policies.

3.5 Refunds

All purchases are processed by Apple through the App Store. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We do not have the ability to issue refunds directly.

3.6 Restore Purchases

If you reinstall the App or switch devices, you can restore your prior purchases using the "Restore Purchase" option within the App. Restoring requires you to be signed in to the same Apple ID used for the original purchase.

4. Permitted Use and Restrictions

The App is designed to help you locate and track Bluetooth devices that belong to you or that you have permission to track. You agree to use the App only for lawful purposes and in a manner consistent with these Terms.

5. Bluetooth and Device Permissions

The App requires access to your device's Bluetooth hardware to function. By using the App you authorise it to scan for nearby Bluetooth Low Energy (BLE) devices and to operate in the background to monitor proximity to your saved devices. You may revoke Bluetooth permission at any time in iOS Settings, but doing so will prevent the App from functioning.

You authorise the App to send local notifications when a saved device is found or lost, subject to your notification preferences within the App and iOS Settings.

6. Intellectual Property

The App, including its design, graphics, user interface, code, and content, is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

The limited licence granted in Section 2 does not include any right to use the Developer's name, trademarks, logos, or other brand features without prior written consent.

Your use of these third-party services is governed by their respective terms and policies. We are not responsible for the practices of third-party services.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities; in such cases the above exclusions apply only to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Developer and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App in violation of these Terms; (b) your violation of any applicable law; or (c) your infringement of any third-party rights.

11. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any of their provisions. Upon termination you must cease all use of the App and delete all copies in your possession.

We may also discontinue or modify the App at any time. Active paid subscribers will be notified of material changes that affect their subscription via the contact information associated with their Apple ID.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or the competent courts of the jurisdiction in which the Developer is established, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

If you are a consumer in the European Union, you also have the right to submit a complaint to your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Apple-Specific Terms

These Terms are between you and the Developer only, not with Apple Inc. Apple is not responsible for the App or its content. In the event of any conflict between these Terms and Apple's App Store Terms of Service, Apple's terms shall govern solely with respect to Apple's rules and policies.

Apple has no obligation to provide maintenance or support for the App. To the extent that the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund any applicable purchase price; Apple has no other warranty obligation with respect to the App.

Apple is a third-party beneficiary of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

14. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and Apple's EULA, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.
