Important: By downloading, installing, or using StepWise, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the StepWise mobile application ("App") provided by Myriad Tech Labs Inc. ("we", "us", or "our"). By using the App, you accept and agree to be bound by these Terms and our Privacy Policy.
2. Subscription Services
2.1 Subscription Tiers
StepWise offers the following subscription options:
- Free Version: Access to core features with advertisements
- Weekly Subscription: $1.99 per week with a 3-day free trial
- Yearly Subscription: $19.99 per year (best value)
2.2 Auto-Renewal
Automatic Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel at least 24 hours before the renewal date. You will be charged through your Apple ID account at confirmation of purchase.
2.3 Free Trial
The Weekly Subscription includes a 3-day free trial for first-time subscribers. You can cancel anytime during the trial period without being charged. If you don't cancel before the trial ends, you will automatically be charged the subscription fee.
2.4 Payment
- All payments are processed through Apple's App Store
- Prices are in U.S. Dollars and may vary by region
- Pricing is subject to change with notice
- We do not have access to your payment information
3. Cancellation and Refunds
3.1 How to Cancel
You can cancel your subscription at any time through your Apple ID settings:
- Open Settings on your iPhone
- Tap your name at the top
- Tap "Subscriptions"
- Select StepWise and tap "Cancel Subscription"
Alternatively, you can use the "Restore Purchases" button in the StepWise app Settings.
3.2 Refund Policy
- All sales are final and processed through Apple's App Store
- Refund requests must be submitted directly to Apple
- We do not provide refunds for partial subscription periods
- Cancellation does not entitle you to a refund for the current billing period
- Your subscription remains active until the end of the current billing period
3.3 Requesting a Refund from Apple
To request a refund from Apple:
- Visit reportaproblem.apple.com
- Sign in with your Apple ID
- Find your StepWise purchase
- Select "Request a Refund" and follow the prompts
4. Health and Fitness Disclaimers
Not Medical Advice: StepWise is designed for general fitness and wellness purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The information provided by the App should not be considered medical advice.
4.1 Consult Healthcare Professionals
Before starting any new fitness program or making health-related decisions based on data from the App, you should consult with a qualified healthcare professional, especially if you:
- Have a pre-existing medical condition
- Are pregnant or nursing
- Are taking any medications
- Have concerns about your physical fitness
4.2 Data Accuracy
- Step counts and health metrics are estimates based on Apple HealthKit data
- Data accuracy depends on your device's sensors and HealthKit integration
- We do not guarantee 100% accuracy of health data
- Metrics should be used as general guidance, not precise measurements
4.3 Use at Your Own Risk
You acknowledge and agree that you use the App and rely on any health information at your own risk. We are not responsible for any health issues, injuries, or adverse effects resulting from your use of the App.
5. User Conduct and Acceptable Use
When using StepWise, you agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App in any way that could damage, disable, or impair the service
- Not attempt to gain unauthorized access to any systems or data
- Comply with all applicable local, state, national, and international laws
6. Intellectual Property Rights
6.1 Ownership
The App, including all content, features, functionality, designs, graphics, code, and trademarks, is owned by Myriad Tech Labs Inc. and is protected by United States and international copyright, trademark, and other intellectual property laws.
6.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. This license does not include:
- Any right to resell or commercial use of the App
- Any right to modify, copy, or create derivative works
- Any right to use data mining, robots, or similar data gathering tools
6.3 Your Data
You retain all rights to your personal health data. However, all data remains stored locally on your device through Apple HealthKit. We do not claim ownership of your health information.
7. Privacy and Data Collection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key Privacy Points:
- All health data stays on your device
- We do not collect or store your health information on our servers
- Free version displays non-personalized ads via Google AdMob
- No user accounts or login required
8. Advertisements
The free version of StepWise displays advertisements provided by third-party advertising networks (Google AdMob). By using the free version, you agree to:
- View non-personalized advertisements
- Have ad content served by third-party providers
- Allow frequency capping and ad delivery optimization
Premium subscribers (Weekly or Yearly plans) enjoy a completely ad-free experience.
9. Third-Party Services
9.1 Apple Services
The App integrates with Apple services including:
- Apple HealthKit: For reading step and health data
- Apple App Store / StoreKit: For subscription processing
- Apple Health App: For data storage and access
Your use of these services is subject to Apple's terms and conditions.
9.2 Third-Party Links
The App may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party sites. You access third-party sites at your own risk.
10. Disclaimers and Limitations of Liability
10.1 "AS IS" Basis
Disclaimer: THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 No Warranty
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Health data will be 100% accurate
- Defects will be corrected
- The App is free from viruses or harmful components
- Results from using the App will meet your expectations
10.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYRIAD TECH LABS INC. SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Health issues or injuries resulting from App use
- Errors or inaccuracies in health data
- Damages resulting from reliance on App information
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS, OR $50, WHICHEVER IS LESS.
10.4 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Myriad Tech Labs Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any health issues or injuries resulting from App use
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.
We will notify users of material changes via:
- In-app notifications
- Email (if provided)
- Updated "Last Updated" date at the top of this page
13. Changes to Pricing
We reserve the right to change subscription pricing at any time. Price changes will:
- Not affect your current subscription period
- Apply to renewals after the change takes effect
- Be communicated to you before the renewal
- Give you the option to cancel before being charged the new price
14. Termination
14.1 Your Right to Terminate
You may terminate your use of the App at any time by:
- Canceling your subscription (if applicable)
- Deleting the App from your device
- Revoking HealthKit permissions in iOS Settings
14.2 Our Right to Terminate
We reserve the right to suspend or terminate your access to the App at any time, without notice, for:
- Violation of these Terms
- Fraudulent or illegal activity
- Abuse of the service
- Any other reason at our sole discretion
14.3 Effect of Termination
Upon termination:
- Your subscription will not renew
- You will lose access to premium features (if applicable)
- Locally stored data will remain on your device (in Apple Health)
- These Terms will continue to apply to your prior use
15. Children's Privacy
StepWise is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately.
16. International Use
The App is controlled and operated from the United States. If you access the App from outside the United States, you do so at your own risk and are responsible for compliance with local laws.
17. Apple-Specific Terms
For users who download the App through the Apple App Store:
- These Terms are between you and Myriad Tech Labs Inc., not Apple
- Apple has no obligation to provide support or maintenance
- Apple is not responsible for product liability claims
- Apple is not responsible for addressing any claims relating to the App
- Apple is a third-party beneficiary of these Terms
- You must comply with Apple's App Store Terms of Service
18. Dispute Resolution
18.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
18.2 Arbitration Agreement
Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. You agree to waive your right to a jury trial or to participate in a class action.
18.3 Exceptions to Arbitration
Either party may seek relief in small claims court for disputes within that court's jurisdiction. Additionally, disputes relating to intellectual property rights may be brought in state or federal court.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Myriad Tech Labs Inc. regarding the use of the App and supersede all prior agreements and understandings.
21. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative.

23. Acknowledgment
By using StepWise, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge that you have read and understood our Privacy Policy.
