Terms of Use

Welcome to NutriScan AI! These Terms of Use ("Terms") govern your access to and use of the NutriScan AI mobile application (the "App") provided by Myriad Tech Labs ("we," "our," or "us").

By downloading, installing, or using NutriScan AI, you agree to be bound by these Terms. If you do not agree, please do not use the App.

By accessing or using NutriScan AI, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

To use NutriScan AI, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Comply with all applicable laws and regulations
• Not be prohibited from using the App under applicable law

If you are under 18, you must have your parent or legal guardian's permission to use the App and agree to these Terms.

NutriScan AI offers the following subscription options:

3.1 Free Plan

• Limited to 5 scans per account (lifetime limit)
• Advertisements are displayed
• Standard customer support
• Cannot be restored or reset

3.2 Premium Subscriptions

• Unlimited Scans: No limit on the number of nutrition label scans
• No Advertisements: Ad-free experience throughout the app
• Priority Support: Faster response times to your inquiries

4.1 Important Trial Information

• Free trial is available only once per Apple ID
• You must cancel at least 24 hours before the trial ends to avoid being charged
• If you previously subscribed (even if cancelled), you are not eligible for the free trial
• Full access to all premium features during the trial period

5.1 Payment Processing

All payments are processed through Apple's App Store using your Apple ID payment method. We do not store or have access to your payment information.

5.3 Price Changes

We reserve the right to change subscription prices at any time. If we increase prices:

• You will be notified at least 30 days in advance
• The new price applies to the next billing cycle after notification
• You can cancel before the new price takes effect
• Continued use after the price change constitutes acceptance

6.1 How to Cancel

You can cancel your subscription anytime through:

1. Open the Settings app on your iPhone or iPad
2. Tap your name at the top
3. Tap Subscriptions
4. Select NutriScan AI
5. Tap Cancel Subscription

6.2 Cancellation Policy

• Cancel at least 24 hours before the next billing date to avoid charges
• Your subscription remains active until the end of the current billing period
• No partial refunds for unused time in the current billing period
• After cancellation, you will revert to the Free Plan (5 scans limit)

6.3 Refund Policy

Request a Refund from Apple:

1. Visit reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find NutriScan AI subscription purchase
4. Select "Request a Refund" and explain why
5. Submit your request

Apple typically responds within 48 hours. Approval is at Apple'\''s sole discretion.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your Apple device
• Use the App for your personal, non-commercial purposes
• Access features based on your subscription tier

7.1 Restrictions

You agree NOT to:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, translate, or create derivative works
• Remove or alter any proprietary notices or labels
• Use the App for any illegal or unauthorized purpose
• Share your account with others
• Attempt to circumvent subscription limitations
• Use automated tools (bots, scrapers) to access the App
• Resell, rent, lease, or distribute the App or your account

You agree to use NutriScan AI responsibly and in compliance with all applicable laws. You will NOT:

• Upload content that is illegal, harmful, threatening, abusive, or defamatory
• Use the App to violate any third-party rights
• Attempt to gain unauthorized access to our systems or other users'\'' accounts
• Introduce viruses, malware, or harmful code
• Interfere with or disrupt the App'\''s functionality
• Use the App in any way that could damage our reputation
• Collect or harvest user information without consent

Violation of these terms may result in immediate termination of your account and subscription without refund.

All rights, title, and interest in and to NutriScan AI, including all intellectual property rights, are and will remain the exclusive property of Myriad Tech Labs.

9.1 Our Property

• App source code and software
• User interface design and layout
• Logos, trademarks, and branding
• Content, text, graphics, and images
• AI models and algorithms

9.2 Your Content

You retain all rights to the photos you upload. By using the App, you grant us a limited license to:

• Process your photos for nutrition analysis
• Use AI/ML services to extract nutritional information
• Store analysis results locally on your device

We do NOT:

• Store your photos permanently on our servers
• Share your photos with third parties (except processing services)
• Use your photos for advertising or other purposes

10.2 Accuracy Disclaimer

While we strive for accuracy, we cannot guarantee:

• 100% accurate nutrition data extraction
• The App may misread labels due to image quality, lighting, or other factors
• AI technology can make mistakes in interpreting labels
• Always verify critical information on the original product label
• Nutritional values may vary between batches and regions

10.3 "AS IS" Provision

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Accuracy, reliability, or completeness of content

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYRIAD TECH LABS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage resulting from use of the App
• Health issues arising from dietary decisions based on App information
• Allergic reactions or adverse health effects
• Errors or inaccuracies in nutrition data

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

NutriScan AI integrates with third-party services:

11.1 OpenAI API

• Used for AI-powered nutrition label analysis
• Subject to OpenAI'\''s Terms of Service and Privacy Policy
• We are not responsible for OpenAI'\''s services or data practices

11.2 Google AdMob

• Displays advertisements to free users
• Subject to Google'\''s Terms of Service and Privacy Policy
• We are not responsible for ad content or third-party advertiser practices

11.3 Apple Services

• In-app purchases processed through Apple App Store
• Subject to Apple'\''s Terms and Conditions
• Camera and photo library access governed by iOS permissions

We are not responsible for any third-party services, their availability, content, or practices.

Your use of NutriScan AI is also governed by our Privacy Policy, which explains:

• What information we collect
• How we use your information
• Third-party data sharing (OpenAI, AdMob)
• Your privacy rights (GDPR, CCPA)
• Data security measures
• App Tracking Transparency (ATT) compliance

By using the App, you consent to our data practices as described in the Privacy Policy.

13.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Cancelling your subscription (if applicable)

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the App immediately, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Attempts to circumvent subscription limitations
• Any conduct that harms us, other users, or third parties

13.3 Effect of Termination

• Your right to use the App immediately ceases
• You must delete the App from all devices
• No refunds will be provided for terminated accounts (unless required by law)
• Locally stored data may be deleted
• Provisions that by their nature should survive (disclaimers, liability limitations) remain in effect

If you access NutriScan AI through the Apple App Store, you agree to the following:

14.1 Acknowledgment

• These Terms are between you and Myriad Tech Labs, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support

14.2 Scope of License

• The license is limited to a non-transferable right to use the App on Apple devices you own or control
• Must comply with Apple'\''s Media Services Terms and Conditions

14.3 Third-Party Beneficiary

• Apple is a third-party beneficiary of these Terms
• Apple has the right to enforce these Terms against you

14.4 Product Claims

• We, not Apple, are responsible for addressing any claims related to the App
• This includes product liability, legal compliance, and intellectual property claims

You agree to indemnify, defend, and hold harmless Myriad Tech Labs, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Health issues or allergic reactions resulting from reliance on App information
• Any content you upload to the App

16.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

16.2 Arbitration

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the American Arbitration Association'\''s rules, except:

• You may bring small claims court actions
• We may seek injunctive relief in court for intellectual property violations

16.3 Class Action Waiver

You agree that disputes must be brought on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your rights without our prior written consent. We may assign or transfer our rights without restriction.

17.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemics, internet outages, or third-party service failures.
